1. About this Privacy Policy

This Privacy Policy explains how eversellaā„¢ ('eversella', 'we', 'us' or 'our') collects, uses, discloses and protects your personal information when you visit www.eversella.com (the 'Website'), buy or use our products, or interact with us on social media or by message.

We are committed to protecting your privacy and handling your personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Website or giving us your information, you agree to this Privacy Policy. It forms part of our Terms and Conditions.

2. The information we collect

We collect personal information that you give us and that we gather as you use the Website. This may include:

  • your name, email address, phone number and billing or location details;
  • your account login details for any course or members' area;
  • your purchase and transaction history;
  • payment information, which is processed by our payment provider (we do not store full card numbers ourselves);
  • the content of your messages, comments, reviews and enquiries, including on social media and in chat;
  • your social media handle or profile when you interact with our accounts or automated messages;
  • technical information such as your IP address, device, browser, and how you use the Website.

You do not have to give us your personal information, but if you do not, we may not be able to provide a product or respond to you.

We do not generally collect sensitive information, such as health or similar information. If we ever need to, we will only collect it with your consent or where the law allows.

3. How we collect your information

We collect personal information:

  • directly from you, when you buy a product, create an account, opt in to a freebie or email list, comment on or reply to our posts and ads, or contact us;
  • automatically, through cookies and similar technologies when you use the Website (see clause 4);
  • from third parties, such as our payment, marketing and advertising providers and the social media platforms you use to reach us.

Where we receive your information from a third party, we take reasonable steps to handle it in line with this Policy.

4. Cookies, pixels and tracking technologies

The Website uses cookies and similar technologies, including advertising pixels and tags from platforms such as Meta (Facebook and Instagram), TikTok and Google. These help us run the Website, remember your preferences, understand how the Website is used, and show and measure our advertising.

Some cookies are essential for the Website to work. Others are used for analytics and advertising. You can control or disable cookies through your browser settings, though some features may not work properly if you do. Where required, we will ask for your consent to non-essential cookies.

5. How we use your information

We use your personal information to:

  • provide, deliver and support the products you buy, and manage your account;
  • process payments and prevent fraud;
  • respond to your enquiries and provide customer service;
  • send you service messages about your purchases;
  • send you marketing, where you have agreed to receive it (see clause 6);
  • personalise, operate, measure and improve the Website, our products and our advertising;
  • run and target our advertising on social media and other platforms;
  • understand our audience and improve what we offer;
  • meet our legal, tax and record-keeping obligations.

We only use your information for the purposes it was collected for, related purposes you would reasonably expect, or as the law allows or requires.

6. Marketing communications and your choices

If you have agreed, or where the law otherwise allows, we may send you marketing by email, SMS and automated chat messages on platforms such as Instagram, Facebook Messenger and TikTok, including through tools such as ManyChat.

You can opt out at any time by using the unsubscribe link in our emails, replying STOP to messages, adjusting your message settings, or contacting us. We will action your request promptly. Opting out of marketing does not stop essential messages about a product you have bought.

7. Who we share your information with

We do not sell your personal information. We share it only as needed to run our business, including with:

  • our e-commerce, checkout and course platform providers;
  • our payment processor;
  • our email marketing and messaging providers, including chat automation tools such as ManyChat;
  • analytics and advertising platforms, such as Meta, TikTok and Google;
  • IT, hosting and support providers;
  • our professional advisers, such as accountants and lawyers;
  • government or law enforcement bodies, where we are required or permitted by law;
  • a buyer or successor, if our business is sold or restructured.

We ask our providers to protect your information and to use it only for the services they provide to us.

8. Overseas disclosure

Some of our providers, including advertising, payment, email, chat and hosting providers, are located or store data outside Australia, including in the United States and other countries. By using the Website and our services, you acknowledge that your personal information may be stored or processed overseas. We take reasonable steps to ensure it is handled consistently with this Policy and the law.

9. How we store and protect your information

We store your information in systems operated by us and our providers, and we take reasonable steps to protect it from misuse, loss, and unauthorised access, modification or disclosure, including through access controls and secure platforms. No method of storage or transmission is completely secure, so we cannot guarantee absolute security. You are responsible for keeping your account login details safe.

If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

10. How long we keep your information

We keep your personal information only for as long as we need it for the purposes in this Policy, or for as long as the law requires, for example for tax and financial records. When we no longer need it, we take reasonable steps to delete it or de-identify it.

11. Accessing and correcting your information

You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong or out of date. Contact us using the details in clause 17. We will respond within a reasonable time. There is normally no charge, though in some cases a reasonable charge may apply for access. If we cannot give you access, we will tell you why.

12. Making a complaint

If you think we have mishandled your personal information or breached the Australian Privacy Principles, please contact us first using the details in clause 17, and we will try to resolve it. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.

Where those laws apply to us, we will honour the rights they give you, including rights to access, correct, delete or object to the use of your information. Contact us using the details in clause 17 to exercise them.

16. Changes to this Privacy Policy

We may update this Privacy Policy from time to time. The current version is always available on the Website, with its effective date shown at the top.
