eversellaā„¢
Terms and Conditions

Effective date:Ā 01 January 2026

1. About these Terms

These Terms and Conditions ('Terms') govern your access to and use of the eversellaā„¢ website at www.eversella.com, and your purchase and use of any product, course, download, template, membership or service we offer ('eversella', 'we', 'us' or 'our').

By accessing the Website, creating an account, or purchasing or using anything we offer, you agree to be bound by these Terms, our Privacy Policy, and any extra terms that apply to a specific Product. If you do not agree, do not use the Website or buy our Products.

Please read these Terms carefully. They include important limits on our liability, a no-refund policy for digital products, and a clear statement that we do not guarantee any income or results.

2. Definitions

In these Terms:

  • 'Content' means all material we make available, including courses, videos, audio, downloads, templates, spreadsheets, workbooks, images, automations, text and written guidance.
  • 'Products' means any digital product, course, download, template, membership, subscription or other item we offer for sale.
  • 'Website' means www.eversella.com and any related pages, funnels or checkout pages we operate.
  • 'You' or 'your' means the person using the Website or buying or using a Product, and any business you act for.
  • 'Intellectual Property' means all copyright, trade marks, designs, know-how, methods, systems and other proprietary rights in the Content and Products.

3. Eligibility

You must be at least 18 years old and able to enter a legally binding contract to use the Website or buy our Products. By purchasing, you confirm that you meet these requirements and that the information you give us is true and complete. If you buy on behalf of a business, you confirm you are authorised to bind that business to these Terms.

4. Your account

Some Products require you to create an account or log in to a course platform. You are responsible for keeping your login details secure and for all activity under your account. You must not share, sell or transfer your account, logins or downloads to anyone else. Sharing access breaches these Terms and may result in your access being suspended or cancelled without refund. Tell us straight away if you suspect any unauthorised use of your account.

5. Products and access

Our Products are digital. They are delivered online, usually by instant download or by access to an online course or members' area. No physical goods are shipped.

Access is granted for the period stated on the sales page for each Product. Some Products give ongoing or lifetime access; others, including any membership or subscription, give access only for the paid term. 'Lifetime' access means for as long as we keep operating the relevant Product or platform, and does not mean forever in every circumstance.

We may update, improve or change the content of a Product at any time. We are not required to keep any particular feature, lesson or format available indefinitely.

6. Pricing, payment and subscriptions

All prices are in United States dollars (USD) unless stated otherwise, and are payable at the time of purchase.

At checkout you may be offered optional add-ons ('order bumps') and follow-on offers ('upsells'), including courses priced above the entry product. These are clearly marked and are only charged if you choose to accept them. You do not have to buy any order bump or upsell to use the Product you came for.

You authorise us and our payment providers to charge your chosen payment method for the total shown at checkout, including any order bump or upsell you accept. Where we are required to collect GST, sales tax or a similar tax on a sale, that amount will be shown or added at checkout. You are responsible for any currency conversion, bank or card fees charged by your provider.

You agree not to make a fraudulent or unjustified chargeback. If you start a chargeback or payment dispute in breach of these Terms, we may suspend your access and recover the amount owing, plus any associated costs.

Refusing or cancelling an order. We may refuse or cancel any order at our discretion, including where we suspect fraud or a breach of these Terms. If we cancel an order you have paid for, and you are not in breach, we will refund that payment.

Subscriptions and auto-renewal. Some Products are sold as a subscription or membership with recurring billing, for example a monthly or annual plan. By buying one, you authorise us to charge your payment method automatically at the start of each billing period, at the then-current price, until you cancel. We will tell you the billing amount and cycle before you subscribe.

Cancelling a subscription. You can cancel a subscription at any time, and cancellation takes effect at the end of the current paid billing period. You keep access until then. We do not provide partial-period refunds for a cancellation part-way through a billing period, except where the law requires it. If we change the renewal price, we will give you reasonable notice before it applies, and you may cancel before the change takes effect.

7. Licence and permitted use

When you buy a Product, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use that Product for your own business, and to use any materials we expressly describe as client-use materials in your own work for your own clients.

Unless we have given you express written permission, you may NOT:

  • resell, relicense, sublicense, rent, lend or redistribute any Product or Content, in whole or in part;
  • share, copy, upload or give away your access, logins or downloads to any other person;
  • claim authorship of, or pass off as your own, our methods, systems or materials as a product you sell;
  • use the Content to build a competing course, product or service that reproduces a substantial part of ours;
  • remove any copyright, trade mark or ownership notice.

No resale or reseller rights of any kind are granted under these Terms. Any resale, white-label or rebrand-and-sell rights would need a separate written licence from us. If we offer such rights in future, they will be governed by their own separate terms.

Breaching this licence immediately ends your right to use the Product, without refund, and may expose you to legal action.

8. Intellectual property

All Intellectual Property in the Website, the Products and the Content is owned by eversellaā„¢ or its licensors. Buying a Product gives you only the licence described in clause 7. It does not transfer any ownership to you. All rights not expressly granted are reserved.

The eversellaā„¢ name, logo, tagline and branding are our trade marks. You must not use them except as we permit in writing.

9. No refunds

Because our Products are digital and are delivered or made accessible immediately after purchase, all sales are final. We do not offer refunds, returns or exchanges for change of mind.

The reasons for this policy are:

  • the Products are delivered instantly and cannot be returned once accessed, downloaded or viewed;
  • the full value, our methods, templates and content, is received as soon as you access them;
  • you are told, before you buy, exactly what each Product contains.

Please make sure a Product is right for you before you purchase. If you are unsure, contact us with your questions first.

This no-refund policy does not apply to, and nothing in these Terms limits, any right or remedy you have under the Australian Consumer Law or other laws that cannot be lawfully excluded. Where such a right applies, for example if a Product is not supplied with due care, is not as described, or does not do what we said it would, you may be entitled to a remedy as required by law. See clause 24 (Australian Consumer Law).

If you buy from outside Australia, you may also have rights under the consumer laws of your own country that cannot be excluded. Nothing in these Terms limits those rights where they apply.

10. No income, earnings or results guarantee

eversellaā„¢ sells education and tools. We do not guarantee that you will earn any money, make any sales, reach any level of income, or achieve any particular result from using our Products.

Our marketing, including phrases such as 'make money every day' and 'payday is every day', describes what our methods are designed to help you work towards. It is not a promise, projection or guarantee of your results. Phrases like these are aspirational and describe a goal, not an expected or typical outcome.

Any figures, case studies, screenshots or examples of income or sales, whether ours or a customer's, are not typical and are not a promise that you will achieve the same. Your results depend on many factors outside our control, including your own effort, skill, experience, offer, market, audience, timing, consistency and the amount of work you put in.

You accept full responsibility for your own business decisions and your own results. You should not buy any Product on the assumption that you will earn a specific amount, or any amount at all.

11. Educational content only, not professional advice

All Content is general information and education. It is not financial, investment, legal, tax, accounting, medical or other professional advice, and it does not take account of your particular circumstances. You should get your own professional advice before acting on anything in our Products. We are not your adviser, agent, mentor, partner or employer, and no fiduciary or advisory relationship is created by your purchase.

12. Disclaimer of warranties

To the maximum extent permitted by law, the Website, the Products and the Content are provided on an 'as is' and 'as available' basis, without warranties of any kind, whether express or implied. We do not warrant that the Website or Products will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any result or outcome will be achieved. Nothing in this clause excludes any guarantee or warranty that cannot be excluded under the Australian Consumer Law.

13. Limitation of liability

To the maximum extent permitted by law:

  • our total liability to you for any claim arising out of or in connection with a Product, the Content or the Website is limited to the amount you actually paid us for the Product that gave rise to the claim;
  • we are not liable for any indirect, incidental, special or consequential loss, or for any loss of profit, revenue, savings, data, goodwill or business opportunity, however it arises, even if we were told such loss was possible;
  • we are not liable for any loss or damage caused by your reliance on the Content, your business decisions, your use of any third-party tool or platform, or any act or omission outside our reasonable control.

Where the Australian Consumer Law or another law implies a guarantee that cannot be excluded, and we are permitted to limit our liability for failing to meet it, our liability is limited, at our option, to resupplying the Product or paying the cost of resupplying it.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, restricted or modified.

14. Indemnity

You agree to indemnify and hold harmless eversellaā„¢, and its owners, officers, contractors and staff, from and against any claim, loss, liability, cost or expense (including reasonable legal costs) arising out of or in connection with:

  • your breach of these Terms;
  • your misuse of any Product or Content;
  • your breach of any law or any third party's rights, including by reselling, copying or sharing our Products; or
  • any claim by a third party relating to how you ran your own business or used what you learned from us.

15. Communications and marketing

When you buy from us, opt in on our Website, or message us or comment on our social media accounts, you agree that we may contact you about your purchase and our services. We send marketing by email, SMS and automated chat messages (on platforms such as Instagram, Facebook Messenger and TikTok, including through tools such as ManyChat) only where you have given express consent, for example by opting in at checkout or in a chat flow.

Automated messages may be triggered when you comment on, or reply to, our posts and ads. Message and data rates may apply, and message frequency varies. You can opt out at any time by using the unsubscribe link in our emails, replying STOP to messages, or contacting us. Opting out of marketing does not stop essential messages about a Product you have bought. We handle your information in line with our Privacy Policy.

16. Acceptable use

You agree not to:

  • use the Website or Products for any unlawful, misleading or harmful purpose;
  • copy, scrape, hack, reverse engineer, or interfere with the Website or its security;
  • upload anything harmful, or try to gain unauthorised access to any account or system;
  • harass, abuse or defame us, our staff, or other customers, including in comments, reviews or messages.

We may suspend or cancel your access, without refund, if you breach this clause.

17. Third-party platforms and links

Our Products are often delivered or supported by third-party platforms and tools, such as course hosts, payment processors, email and messaging tools (including ManyChat) and social media platforms. We do not control these services, and your use of them is subject to their own terms and privacy policies. We are not responsible for their availability, acts, errors, fees or changes. The Website may link to third-party sites; we provide links for convenience only and do not endorse or take responsibility for their content.

18. Testimonials, reviews and examples

Any testimonials, reviews, results or examples we show are the genuine experience or opinion of the person giving them, at a point in time. They are individual results. They are not typical, not verified for every case, and not a guarantee that you will achieve the same or similar results. See clause 10.

By sending us a testimonial, review, comment or other feedback, you give us an ongoing, royalty-free permission to use, reproduce and share it in our marketing and on our Website, identified by your first name or as you otherwise allow, unless you ask us in writing not to.

19. Privacy

We collect and handle personal information in line with our Privacy Policy, which forms part of these Terms. By using the Website or buying a Product, you consent to us collecting, using and disclosing your information as described in that policy. Our Privacy Policy is available on our website at www.eversella.com.

20. Suspension and termination

We may suspend or end your access to any Product or the Website, without notice and without refund, if you breach these Terms, misuse a Product, share or resell access, or start an unjustified chargeback. On termination, your licence ends and you must stop using and delete any downloaded Content, except where the law allows you to keep it. Clauses that by their nature should survive, including those on intellectual property, no refunds, no guarantees, liability and indemnity, continue to apply after termination.

21. Changes

We may change our Products, their pricing, their features, and these Terms at any time. Changes to these Terms take effect when we post the updated version on the Website with a new effective date. Your continued use of the Website or Products after a change means you accept the updated Terms. A change to the price of a Product does not affect a purchase you have already completed.

22. Events outside our control

We are not liable for any failure or delay in providing a Product or the Website that is caused by events outside our reasonable control, including outages or changes by third-party platforms, internet or power failures, cyber attacks, natural disasters, illness, or government action.

23. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts that hear appeals from them.

Before starting any formal proceedings, you agree to first contact us and try in good faith to resolve the dispute. Most issues can be sorted out quickly if you reach out to us directly.

24. Australian Consumer Law

Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms, including the no-refund policy in clause 9 and the limitations in clauses 12 and 13, excludes, restricts or modifies any consumer guarantee, right or remedy that the law says cannot be excluded, restricted or modified.

Where we are permitted by law to limit our liability for failing to meet a consumer guarantee, our liability is limited to resupplying the Product or paying the cost of resupply. This limit does not apply to goods or services of a kind ordinarily acquired for personal, domestic or household use, where the law does not allow it.

If there is any conflict between these Terms and a right you have under the Australian Consumer Law, the law prevails.

25. General

  • If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest continues to apply.
  • These Terms, the Privacy Policy, and any product-specific terms are the entire agreement between you and us about their subject matter, and replace any earlier representations or understandings.
  • If we do not enforce a right under these Terms, that is not a waiver of that right.
  • You may not assign or transfer your rights under these Terms. We may assign ours, for example if our business is sold.
  • Nothing in these Terms creates a partnership, agency, employment or joint venture between you and us.
  • Headings are for convenience only and do not affect how these Terms are read.

26. Contact us

If you have any questions about these Terms or a Product, please contact us before you purchase. You can reach us through the contact page on our website.
